LAW TIGERS: In Case of an Accident

TEAM Arizona’s legal sponsor, Law Tigers, provided us with some helpful information should we ever find ourselves in a motorcycle crash. We recommend keeping a copy of this in any of your vehicles.
1. Identify Drivers and Witnesses
Obtain the other driver(s) name, address, and phone number. Document license plate and registration of any vehicles involved. Ask other involved parties to provide you with their driver’s license, phone number, and insurance information. It is equally important that you gather name, address, and phone number from any and all eye witnesses, and if possible, a written statement of what they saw.
2. Comments and Statements
Do not discuss the accident with anyone except the investigating police officer and even then, only talk about the basic facts. Never admit liability. Who was at fault will be figured out in the investigation process and if it’s a serious accident involving injury, you will want to make statements only to your lawyer.
3. Take Notes and Photographs of the Accident
Make note of circumstances concerning the accident and be sure to take pictures of vehicle position, skid marks, and as many details of the scene as possible.
4. Cooperating with the Police
Any statement may be used as admission, so it is very important to make no statement until you have secured representation from a qualified attorney.
5. When to Leave the Accident Scene
Unless your injuries require otherwise, do not leave the scene of an accident until you have assisted the injured, protected the scene, obtained and recorded the information listed above, called police, and assisted them as needed. Remember, even serious injuries are not always evident at the time of a collision. See your doctor immediately and advise any of your passengers to do the same.
6. Insurance Reports and Notifications
Immediately notify your insurance company and document this notification. Failure to do so may cause them to deny coverage. Do not give a statement without first consulting your lawyer.
